Terms of service

These terms form an agreement between you and HQK ADVERTISING - INTERIOR COMPANY LIMITED ("we") for the use of Postbackly. If you use the service for a company, you accept them on its behalf and confirm that you are authorized to do so.

The service

Postbackly provides tracking links with a transparent redirect, a postback API for reporting conversions, reports and tools to approve, reject and export conversions for commission reconciliation. Reports reflect the clicks we record and the postbacks you or your partners send; we do not verify that a reported sale actually happened.

Who can use it

The service is for businesses and professionals acting in the course of their trade. You must be at least 18 and give accurate account details.

Acceptable use

  • Use tracking links only for offers you own or are authorized to promote, and send postbacks only for real transactions.
  • Do not use the tracker to redirect to phishing, malware, scams, counterfeit goods or other content that is illegal or violates the policies of the advertising platforms you use, and do not use it in spam or to hide where a link goes.
  • Do not create fake clicks or conversions, use incentivized or automated traffic that your partners did not agree to, or stuff cookies.
  • Do not put personal data such as names, phone numbers, email addresses, identity numbers or health data into sub IDs, tracking URLs or postbacks.
  • Disclose click tracking in your own privacy notice as required by the laws that apply to you.
  • Do not try to bypass plan limits, access other customers’ data or disrupt the service.

To protect visitors and other customers, we may block destination hosts and suspend links, offers or accounts that break these rules. A blocked link shows an error page and is never redirected anywhere else. Report abuse to abuse@postbackly.click; we review every report.

Commissions and payments between users

Postbackly is a record-keeping tool. We are not a party to agreements between advertisers, networks and publishers, we do not hold, collect or transfer commission money, and we are not responsible for decisions to approve or reject conversions. Use the reports and CSV exports as a basis for your own payments and accounting.

Plans and billing

The Starter plan is free. Paid plans are agreed with us in writing and invoiced monthly or annually in advance; prices exclude VAT. If you go over the clicks or offers of your plan, redirects and postbacks keep working, and we contact you to change plan before any extra charge.

Data processing

For the click and conversion data recorded for your account, you are the controller and we are your processor. This section is our data processing agreement with you, including for the purposes of Article 28 of the GDPR and Vietnam’s Law on Personal Data Protection No. 91/2025/QH15.

  • We process this data only to provide the service, following your documented instructions: these terms and the settings you choose in your dashboard.
  • Everyone at our company with access to the data is bound by confidentiality.
  • We apply the security measures described in our privacy policy.
  • You authorize the sub-processors listed in our privacy policy. We announce new sub-processors on that page and by email at least 30 days in advance; you may object, and if we cannot address your objection, you may close your account.
  • We help you answer requests from data subjects and, where reasonable, with impact assessments.
  • We notify you without undue delay, and where possible within 72 hours, after becoming aware of a personal data breach affecting your data.
  • Raw click data is deleted 90 days after each click and conversions two years after they are recorded; everything is deleted immediately when you delete your account (backups within 14 days).
  • On request we provide the information needed to show that we meet these obligations.

You are responsible for having a legal basis for tracking, for informing visitors, and for the instructions you give us.

Suspension and termination

You can delete your account at any time in Settings; its offers, publishers, clicks and conversions are deleted immediately, so export anything you need first. We may suspend or close an account that breaks these terms, harms other users or visitors, or remains unpaid, with notice where practicable. When an account is closed, its data is deleted as described in our privacy policy.

Disclaimer

The service is provided "as is" and "as available". To the extent the law allows, we make no warranty that it will be uninterrupted or error-free, or that every click or postback will be recorded.

Liability

To the extent the law allows, we are not liable for lost profits, lost commissions or disputes between you and your partners, and our total liability is limited to the fees you paid in the three months before the claim.

Changes to these terms

We may update these terms. We tell account holders by email at least 30 days before a material change takes effect. If you continue to use the service after that, the new terms apply; if you do not agree, you can delete your account.

Governing law

These terms are governed by the laws of Vietnam. Disputes that cannot be settled amicably go to the competent court in Ho Chi Minh City. Contact: contact@postbackly.click.
